Notice to Alternative Fuels Licensed Companies and Certified Individuals
State of Disaster in Texas Waiver Requests
January 23, 2026On January 22, 2026, Governor Greg Abbott issued a proclamation declaring a state of disaster for several Texas counties due to severe winter weather. Pursuant to this declaration and Section 418.016 of the Texas Government Code, the Office of the Governor has authorized the suspension of certain regulatory statutes and rules that may prevent, hinder, or delay necessary action in coping with this disaster.
During this State of Disaster, licensed companies and certified individuals involved in the safe transportation, storage, and distribution of LPG, CNG, and LNG may request waivers for specific regulatory requirements from the Railroad Commission of Texas (RRC). These waiver requests will be reviewed on a case-by-case basis and may include companies with licenses that expired during the disaster period or emergency registration for alternative fuel transport units. To qualify for an emergency registration of a transport unit, the unit must meet US DOT regulations and must meet the minimum insurance requirements in Texas Administrative Code Chapters 9, 13 and 14, as applicable.
Additionally, waivers may be requested for LP-gas transport drivers who are currently certified by Arkansas, Louisiana or New Mexico and have passed one or more of these states’ LP-gas transportdriver examinations. Waiver requests must include the number and expiration of the out of state certification.

The waiver will remain in effect until Jan 30, 2026 unless the state of disaster is terminated sooner by the Office of the Governor.
The RRC reminds all operators to monitor weather reports and heed all warnings from emergency officials. Operators remain responsible for the safe operation of their systems and must maintain the capability to respond to critical safety issues.
